Musk OpenAI Dispute: Elon Musk Seeks $134 Billion From OpenAI and Microsoft

Elon Musk has launched a major legal challenge against OpenAI and Microsoft. In the Musk OpenAI dispute, he seeks up to $134 billion in alleged wrongful gains. Musk filed the claim in federal court on Friday.
He argues that both companies benefited unfairly from his early involvement. According to the filing, OpenAI gained between $65.5 billion and $109.4 billion. Microsoft reportedly gained between $13.3 billion and $25.1 billion.

Claims Linked to Early Support

Musk says he helped build OpenAI from the ground up. For example, he contributed around $38 million in early funding. That amount made up about 60 percent of OpenAI’s seed capital. In addition, he helped recruit staff and connect founders with key contacts.
Musk also claims his public support gave OpenAI instant credibility. As a result, the company attracted talent, partners, and major investors. The filing compares his role to that of an early startup investor. Therefore, Musk argues he deserves returns far beyond his initial contribution.

Dispute Over OpenAI’s Mission

Musk left OpenAI in 2018 but remains closely tied to the AI sector. He now runs xAI, which developed the Grok chatbot. However, Musk alleges OpenAI abandoned its original mission. He claims the company shifted toward profit driven goals. OpenAI strongly rejects these accusations.
The company calls the lawsuit baseless and part of harassment. Microsoft also denies any wrongdoing.
Its lawyers say there is no proof of aiding OpenAI’s actions.

Trial Timeline and Possible Outcomes

A judge in Oakland, California, has approved a jury trial. The case is expected to begin in April. Musk’s legal team relied on expert analysis for the damages estimate. Financial economist C. Paul Wazzan calculated the alleged gains.
If the jury rules in Musk’s favor, penalties could follow. These may include punitive damages or court ordered restrictions. However, the exact form of any injunction remains unclear. Still, the Musk OpenAI dispute could reshape AI partnerships.
